The authority to conduct open burning under the provision of the town ordinance does not exempt or excuse any person from the consequences, damages or injuries which may result from this conduct, nor does it excuse or exempt any person from complying with all applicable laws, ordinances, regulations and orders of the governmental entities having jurisdiction.
While recognizing that open burning contributes to air pollution, the Town Council is aware that certain types of open burning must reasonably be allowed in the public’s interest; therefore, the following are permissible as specified or otherwise prohibited by ordinances and regulations of government entities having jurisdiction.
- Campfires and fires used solely for outdoor cooking and other recreational purposes for ceremonial occasions or for human warmth and comfort
- Open burning of leaves, tree branches or yard trimmings originating on the premises of private residences and burned on those premises in areas where no public pickup facilities are available. *Refer to the Town Brush Pick-up Service and Schedule*
Open burning in other than predominately residential areas for the purpose of land clearing or right-of-way maintenance.
This will be permissible only if initially permitted by the local Fire Department.
